GENERAL TERMS AND CONDITIONS, RETURN POLICY AND PRIVACY STATEMENT

Article 1. Definitions

In these general terms and conditions, the following terms are used in the following meaning, unless expressly stated otherwise.
Memories of Damascus : the user of these general terms and conditions.
Client : the counterparty of Memories of Damascus.

Article 2. General

  1. These terms and conditions apply to every offer, quotation and agreement between Memories of Damascus and a client to which Memories of Damascus has declared these terms and conditions applicable, insofar as the parties have not expressly deviated from these terms and conditions in writing.
  2. Any deviations from these general terms and conditions are only valid if they have been expressly agreed in writing.

Article 3. Offers and quotations

  1. The quotations made by Memories of Damascus are without obligation; they are valid for 14 days, unless otherwise indicated. Memories of Damascus is only bound by the quotations if the acceptance thereof is confirmed in writing by the other party within 14 days, unless otherwise indicated.
  2. Orders for catering, if the price is dependent on the number of participants and this number is provisionally stated in the order, will only be accepted on the condition that the correct number of participants has been communicated to Memories of Damascus by the other party at least 5 working days before the event takes place. Memories of Damascus is entitled to request written notification of this, unless otherwise agreed.
  3. Prices for providing (complete or partial) catering are calculated on the basis of the number of persons specified by the other party. The payment conditions set out in article 5 apply to this. If no reservation has been made for the number of participants in the order, any additional consumption will be charged to the other party afterwards on a post-calculation basis. If the other party does not comply with the obligation to state the number of participants, Memories of Damascus is entitled to calculate the price based on the provisionally stated number of participants.
  4. Memories of Damascus is entitled to charge the other party for price increases that occur after the agreement has been concluded, based on the price index figure for family consumption, or any index figure that replaces it. Price increases based on the aforementioned index figure will only be charged to the other party with effect from 1 January of any year following the calendar year in which the agreement in question was concluded.

Article 4. Payment

  1. For a total amount of €1000.- or more, the client pays 25% of the total price when signing the agreement. The remaining amount will be paid no later than 48 hours before the service in cash or by bank transfer or by electronic payment.
  2. If the down payment is not made on time, Memories of Damascus has the right to terminate the agreement without judicial intervention and notice of default, without the client being entitled to any compensation on that basis. All rights of Memories of Damascus are reserved.
  3. Any collection costs incurred will be borne entirely by the client. 
  4. If the client does not meet his payment obligation within 14 days, the client will be in default without notice of default and the amount owed by the client to Memories of Damascus will be increased by extrajudicial collection costs. These extrajudicial collection costs amount to 15% of the invoice amount, with a minimum of € 115.

Article 5. Cancellation by client

  1. In case of cancellation after final confirmation, the client is at all times obliged to pay € 100 administration costs.
  2. In case of cancellation up to 2 weeks before the agreed delivery date, the client is obliged to pay 25% of the total price.
  3. In case of cancellation from 2 weeks to 2 days before the delivery date, the client is obliged to pay 50% of the total price.
  4. In case of cancellation within 48 hours prior to the delivery date, the client is obliged to pay 100% of the total price.
  5. Cancellation can only be made in writing or by e-mail, preferably preceded by notification of cancellation by telephone as soon as possible.

Article 6. Cancellations by Memories of Damascus

  1. Memories of Damascus is entitled to cancel the agreement due to force majeure. Force majeure shall be deemed to be any foreseeable or unforeseen, foreseeable or unforeseeable circumstances that make the performance of the agreement by Memories of Damascus so difficult that performance becomes reasonably impossible or difficult. Such circumstances shall also include such circumstances with persons and/or services and/or institutions that Memories of Damascus wishes to use in the performance of the agreement, as well as anything that applies to the aforementioned as force majeure or a suspensive or resolutive condition. If possible, Memories of Damascus shall offer the other party (a) replacement option(s) under the same conditions at the agreed time or in a different period.
  2. In the case referred to in paragraph 1, the other party has the right to refuse the alternative offered by Memories of Damascus. A refusal must be made known to Memories of Damascus in writing and no later than 1 week after the offer, failing which the offer is accepted.

Article 7. Partial cancellation

  1. If the number of participants is reduced by more than 10%, the cancellation provisions of Article 5 of these terms and conditions apply.
  2. For additional participants who have not registered 48 hours prior to delivery, a reasonable additional price will be charged.

Article 8. Client liability

  1. The Client is liable for any damage caused by the Client and its guests and employees to property of Memories of Damascus, employees or third parties.

Article 9. Complaints

  1. Any complaints about the services provided, including catering, must be reported immediately on the evening itself.
  2. Memories of Damascus can never be held liable for an amount higher than the total amount agreed.

Article 10. Applicable law and competent court

  1. These terms and conditions and all agreements concluded under these terms and conditions are exclusively governed by Dutch law.
  2. Any disputes arising from these terms and conditions and agreements concluded under these terms and conditions will be submitted exclusively to the competent court in the district of Den Bosch.
  3. Disputes shall be deemed to exist at the time that one of the parties notifies the other party thereof in writing.

Article 11. Rental of materials

  1. Rental conditions
    If Memories of Damascus rents materials (such as crockery, furniture, equipment or decoration) to the client in the context of an event or catering assignment, the following provisions apply.
  2. Retention of title
    All rented materials remain the property of Memories of Damascus at all times. Client may only use these materials for the agreed purpose and during the agreed period.
  3. Use and duty of care
    Client is obliged to handle the rented materials with care and to use them in accordance with their intended purpose. Client is liable for all damage, loss or disappearance of the materials during the rental period, regardless of the cause.
  4. Inspection upon receipt
    The client must inspect the condition of the materials upon receipt of the rented goods. Any damage or defects must be reported immediately upon delivery. In the absence of notification, the materials are deemed to have been delivered in good condition.
  5. Returns
    The rented materials must be returned in their original state, complete and clean after the rental period. Any costs for cleaning or repair will be charged if the materials are not returned correctly.
  6. Loss or damage
    In case of loss or irreparable damage, the new value of the item in question will be invoiced to the client. In case of repairable damage, the repair costs will be charged.
  7. Liability for third parties
    If the materials are used by third parties or sublet without the written permission of Memories of Damascus, the client remains fully liable for all consequences thereof.
  8. Deposit
    Memories of Damascus reserves the right to request a deposit in advance for the rented equipment. This deposit will be refunded within 7 working days after correct and undamaged return, minus any costs for damage, loss or cleaning.

DELIVERY AND RETURNS POLICY


Your order will be shipped (unless otherwise agreed and/or stated) the day after you placed the order.

Products that you buy via our webshop have a limited shelf life and can therefore not be returned. The right of withdrawal is therefore not applicable. The sale is hereby final after successful payment.


It can of course happen that, despite our utmost efforts, you are dissatisfied with our products and/or our service. We would of course like to discuss this with you, to find a suitable solution. If you are dissatisfied with our product, please keep the product and the packaging.
